This Privacy Policy is effective upon acceptance in registration for new registering users and is otherwise effective on May 25th, 2018 for all users.

Completing these requirements you must consider yourself data controller and/or data processor in definition of applicable legal acts.

We also must warn you that providing data you’ve gathered to the 3rd-party services not affiliated with ARC.com like PayPal, Square, Clover and QuickBooks being a subject of Privacy Policy and Terms of Use of that services.

Upon registration you choose to provide some basic information about yourself and your Company.

These data can later be:

  • Used to:

    • Authenticate you in order to use our service;
    • Create and manage the repairs and appointments;
    • Invoicing a customer;
    • Manage your subscription;
    • Allow you to register with selected Suppliers’ service;
    • Communicate with you and provide the way your Customers can communicate with you.

  • Partially provided to:

    • Individuals that use “AutoRepair Cloud for vehicle owners” application in order to allow them to view and manage repairs, adding requests and using search feature;
    • Individuals that use http://www.autorepaircloud.net/ecat/ service in order to promote your Company;
    • Individuals that use Customer portal of your Company;
    • Selected 3rd party services that allowing us to communicate with you.

  • Stored until:

    • You ask us to delete these data;
    • Legal requirement makes us to remove your data.

  • Disposed by:

    • Removing these data from our storage.

b) Information that being collected automatically:

By using our applications you became subject of automatic gathering of certain data regarding your usage of applications. For example, we are using information about device you used with our app in order to adapt our applications to that devices.

These data can later be:

  • Used to:

    • Making research on your preferences and application usage in order to make our app better;
    • Optimize, and maintain our applications;
    • To send you selected marketing information according to your preferences;
    • To manage your requests and identify issues in order to provide better services.

c) Subscription:

To use all the features provided by our app, you can can be interested in Subscription.

To assign Subscription to you, we must receive confirmation from Payment Processor service, currently available only as PayPal, that your payment has been processed.

Note that we do not receive, use nor store any information about your credit card or bank account, PayPal account data except the payment confirmation, payment amount and identifier (pseudonym) used to assign Subscription.

This confirmation and other data related to Subscription can later be:

    • Assigning Subscription to you.

    • Selected 3rd-party services that allowing us to create and manage your subscription.

    • These records must be kept under law.

d) Information about Customer and/or Vehicle:

You can gather and process information about your Customers and/or their vehicles.

Note that you become responsible for the data you’ve gathered and provided (P2.1).

These data can be:

  • Used to:

    • Authenticate them in order to use our service;
    • Create and manage the repairs and appointments;
    • Invoicing a customer;
    • Communicate with them.

  • Partially provided to:

    • Individuals that use “AutoRepair Cloud for shop owners” application in order to allow them to use search feature, being provided partial data by customers.
    • Suppliers in order to create shipment orders (only vehicle data can be provided this way).
    • Selected 3rd party services that allowing us to communicate with them.

  • Stored until:

    • Customer deletes these data;
    • You delete these data if they are not being used by the Customer
    • Legal requirement makes us to remove these data.

  • Disposed by:

    • Removing these data from our storage.

e) Information about Worker:

You can provide access to all or partial information you have stored in our applications to 3rd-party person or company (named a Worker) by creating an unique user account.

Note that you become responsible for the data you’ve gathered and provided (P2.1).

These data can be:

  • Used to:

    • Authenticate them in order to use our service;
    • Create and manage the repairs and appointments;
    • Invoicing a customer;
    • Communicate with them.

  • Partially provided to:

    • Individuals that use “AutoRepair Cloud for vehicle owners” application in order to allow them to view and manage repairs and adding requests;
    • Individuals that use Customer portal of your Company.

  • Stored until:

    • You delete these data;
    • Legal requirement makes us to remove these data.

  • Disposed by:

    • Removing these data from our storage.

f) Your logo and trademarks:

While you can use our applications in order to create personalized Customer portal for your Company and personalized Invoice template. Doing so you voluntarily displaying your copyrighted materials (logo, trademarks or other kind of data protected by law) to the undetermined number of persons.

These materials can be:

  • Used to:
  • Invoicing a customer;
  • Creating a personalized Customer portal for your Company.

  • Partially provided to:

    • Individuals that use “AutoRepair Cloud for vehicle owners” application in order to allow them to view and manage repairs and adding requests;
    • Individuals that use Customer portal of your Company.

  • Stored until:

    • You delete these data;
    • Legal requirement makes us to remove these data.

  • Disposed by:

    • Removing these data from our storage.

    Note that you take all responsibility for content of all copyrighted material you’ve using.

    g) Information about your auto parts orders and inventory:

    You can use our applications in order to create shipment orders for auto parts and related goods and manage your repair shop inventory.

    These information about your inventory and shipment orders can be:

    • Used to:

      • Creating and manage repairs;
      • Manage your auto parts shipment orders and inventory;
      • Invoicing a customer.

    • Partially provided to:

      • Individuals that use “AutoRepair Cloud for vehicle owners” application in order to allow them to view and manage repairs;
      • Suppliers in order to search for auto parts and create shipment orders.
      • Stored until:

      • You delete these data;
      • Legal requirement makes us to remove these data.

    • Disposed by:

      • Removing these data from our storage.

    h) Repair payment processing:

    To complete your repair order you can be interested in receiving payments from your Customers. To display payment status, we must receive confirmation from Payment Processor service, that your payment has been processed.

    Note that we do not receive, use nor store any information about your credit card or bank account, PayPal, Square, Clover or other Payment Processor data except the payment confirmation, payment amount and (in certain cases) identifier (pseudonym) used to display information about the payment.

    This confirmation and other data related to Payment can later be:

    • Used to:

      • View and Manage repairs;
      • Invoicing.

    • Partially provided to:

      • Individuals that use “AutoRepair Cloud for vehicle owners” application in order to allow them to view and manage repairs;

    • Stored until:

      • These records must be kept under law.

    • Disposed by:

      • Removing these data from our storage.

    i) Chat, requests and other messages:

    You can use our applications to communicate with Customers by sending requests, emails, messages through application chat, SMS and PUSH notifications, send and receive files, images, audio and video records.

    This data can later be:


    • Used to:

      • Allowing you, your Workers and Customers to communicate.

    • Partially provided to:

      • Selected 3rd party services that allowing you, your Workers and Customers to communicate.

    • Stored until:

      • You ask us to delete your data;
      • Legal requirement makes us to remove your data.

    • Disposed by:

      • Removing these data from our storage.

    Note that you take all responsibility for content of your messages, notifications and uploaded files under applicable laws.

    j) Decoding VIN/License plates/UPC barcodes:

    You can use our applications to automatically obtain information about vehicle by providing data about vehicles’ Vehicle Identification Number (VIN) and/or License/Registration Plate.

    This data can later be:

    • Used to:

      • Allowing you or your Workers to obtain information about selected vehicle or Order.

    • Partially provided to:

      • Selected 3rd party services that allowing you or your Workers to obtain information about Vehicle or Order.

    • Stored until:

      • You ask us to delete your data;
      • Legal requirement makes us to remove your data.

    • Disposed by:

      • Removing these data from our storage.

    k) Statement on communications:

    By using our app you agree that customers may use your personal information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted banner advertisements, administrative notices, product offerings, and communications relevant to your use of the applications. By accepting the Term of Use and Privacy Policy, you expressly agree to receive this information. If you do not wish to receive these communications, we encourage you to opt out of the receipt of certain communications on the notification preferences page. You may make changes to your notification preferences at any time.

    3.1 Your Use of Others’ Information

    In order to facilitate interaction between all ARC.com community members, our Site allows you limited access other users' contact and shipping information. As a repair shop you have access to the User ID, email address and other contact and shipping information of the customer. By entering into agreement of Terms of Usage, you agree that, with respect to other users' personal information that you obtain through the Site ARC.com hereby grants to you a license to use such information only for: (a) ARC.com-related communications that are not unsolicited commercial messages, (b) using services offered through ARC.com (e.g. escrow, insurance, shipping and fraud complaints), and (c) any other purpose that a user expressly agrees to after you tell them the purpose you would like to use it for. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this Section, can you disclose personal information about another user to any third party without our consent and the consent of that user. You agree that other users may use your personal information to communicate with you in accordance with this Section.

    4. Our Disclosure of Your Information

    As a matter of policy, we do not sell or rent any of your personal information to third parties for their marketing purposes without your explicit consent. However, the following describes some of the ways that your personal information may be disclosed in the normal scope of business to provide our services.

    Your User ID is displayed throughout the Site and is therefore available to the public. All of your activities on the Site will be identifiable to your User ID. Other people can see your feedback rating and associated comments, your postings on the Site, and so on. Therefore, if you associate your name with your User ID, the people you have revealed your name to will be able to personally identify your ARC.com activities. There is some possibility that others may illegally attempt to automatically collect your email address from the Site.

    You are responsible for all actions taken with your User ID and password, including fees charged to your account. Therefore we do not recommend that you disclose your ARC.com password to any third parties. If you choose to share your User ID and password or your personal information with third parties, you are responsible for all actions taken with your account and therefore you should review that third party's privacy policy. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password as detailed in Section 5.2.

    5.2 Accessing, Reviewing and Changing Your Personal Information

    We offer you the ability to automatically review and change the information you submit to us by logging into the Site and entering in the new information yourself. Generally, we will not modify your personal information based on your request because it is very difficult to authenticate your account manually. You can do it by yourself through your account.

    No charge will be taken for opt-in or opt-out of notifications.

    5.4 Account Termination and Data Removal

    Your account can be terminated and your data can be removed in case of:

    • Direct, voluntary and clear request of you or your legal representative;
    • Requirement of the law;
    • Severe infringement of Terms of Use or another agreement with ARC.com you are legally binded to.
